I. INLEIDING
U denkt misschien - soms terecht - dat dit een ver van mijn bed show is. Maar dit raakt ook uw beroep, uw dagdagelijkse manier van leven als kunstenaar. Meer zelfs, op dit congres werd gegraven naar de gronden van democratie en diversiteit.

Zoals een spreker sterk uitdrukte: "What kind of society do we want for our children?.." (Zoe Lanara, Secretary Greek Broadcasting Workers Federation & net verkozen presidente van UNI-Mei)

Een andere spreker: "People join unions for personal reasons". (Tuwani Gumani, Zuid-Afrika)
Een reden te meer om hier uit te leggen hoe veel dichter dit soort congressen bij u staat dan u zou denken...

II. ENKELE TERMEN
- Wat is UNI: Unions Network International, groepeert honderden vakorganisaties die 50 miljoen leden vertegenwoordigen!
- MEI staat voor Media, Entertainment Industries, dus daar valt u ook onder.
- UNI-Mei and its affiliates: leden, met andere woorden de aangesloten vakorganisaties zoals ACV-Cultuur.
- Er wordt grote aandacht besteed aan a-typical workers, tijdelijke werkers, evengoed als aan alle soorten contracten die maar bestaan. Verder hier meer over.

III. OPROEP

Walk of fame - walk of famine...

In Hollywood zijn zowat 100% van de mensen werkzaam in de filmsector, aangesloten bij een vakorganisatie! Het legt hen geen windeieren... Laat dus ook uw rechten verdedigen. Vandaar een OPROEP om u aan te sluiten bij een vakorganisatie.

IV. WAT KWAM AAN BOD
Laten we enkele punten die aan bod kwamen van nabij bekijken:

1. GLOBALISATIE & FUSIES
Zowel in Media als bij muziek- en filmmaatschappijen zien we onrustwekkende concentraties en fusies. AOL & Warner, Vivendi, Berlusconi's imperium dat 90% controleert van de media in Italie, platenmaatschappijen die nu dikwijls globaal zijn en locale maatschappijen van de markt drijven. (Zie ook artikel liberalisatie & cultuur, www.acv-vlopera.be\liberalisatie.html).

PSB (Public Service Broadcasting) wordt gezien als een obstakel in de race naar hegemonie door corporate en politieke krachten.
Maar democratie komt in verdrukking, een verarming van culturele en linguistische rijkdom loert om de hoek.*

2. RECHTEN
2.a. Copyright
Reeds eerder stelde UNI: "the rush for digital rights by powerful corporates challenges the copyright and moral rights of individual creators (including musicians, artists and writers), the rights on which their livelihoods may depend. This is a matter of considerable concern at present for creators in several countries, not least given their relative powerlessness in the face of large institutions.
UNI and several of its affiliates are concerned to ensure that creators' copyright can be adequately defended".

2.b. Guaranteeing rights of creators of art and culture
Resolution 15
The delegates to the Assembly consider the following to be of particular importance:
- The use rights of a production or work will only be assigned to the producer if there is a written agreement; without a contract, there are no use rights. The contract should primarily regulate the following:
a) adequate remuneration for the product, representation or work performed
b) a single, unambiguous description in writing of the rights assigned
c) the payment of a separate, appropriate remuneration for each right assigned
d) the non-validity of the assignment of use rights or their commitment for forms of use yet unknown
- Specific regulations for the use on internet

Resolution 20, blz 2, § 6
The International Community is invited to adapt and approve agreements and instruments to: Ensure the fair remuneration of creators, producers and intermediaries of products and services in the information society.

In mensentaal: wij verdedigen uw rechten wat copyright betreft. We doen dit op meerdere vlakken, nationaal en internationaal. Bent u musicus, componist, schrijver, artiest, sluit u dan aan bij een vakorganisatie en zorg dat uw stem gehoord wordt!

3. INTERNATIONAL TRADE
3.a.1 Resolution 14; WTO
UNI-MEI Assembly:
- Notes with pleasure that WTO (World Trade Organisation) has not considered cultural goods as ordinary merchandise. UNI-Mei insists that this position should be maintained.
Waarom is dit belangrijk: indien men ordinaire handelsregelingen gaat toepassen op media of entertaiment, riskeert men de culturele diversiteit, onafhankelijkheid van nieuwsgaring en verspreiding, enz te vernietigen. Voorbeelden zijn er nu al, denk maar aan de berichtgeving in sommige landen over de oorlog in Irak...
Dichter bij huis hebben we de ongelofelijke concentratie van nieuwsbedrijven van Berlusconi in Italie. Democratie komt in gevaar.
Wat culturele diversiteit betreft: WTO handelsregels houden een gevaar van uniformisering, versmelting en verarmimg in.

3.a.2. Resolution 24, cultural products excluded from multilateral free trade agreements
UNI-Mei reaffirms the principle of cultural exception and requests that cultural products be excluded from the scope of future multilateral free trade agreements and discussions within the WTO (World Trade Organisation).
Because of their diversity and complexity, artistic creations cannot be governed solely by the logic of the marketplace, given that the latter tends to generate concentration and standardisation process which limit cultural diversity.

4. SUPPORT FOR ARTS & CULTURE
Resolution 16
UNI-Mei WGA (World General Assembly):
- believes that the media and the arts are an integral ingredient of a democratic and civilised society.
- the reason is quite simply the centrality of the arts and the media to our understanding of ourselves.
Because arts and the media are so important in the texture of our society, all responsible governments need to ensure that the arts and the media are nurtured, encouraged, enabled and spread.
- Recognises that sometimes it will require courage to say that a specific difficult work should be supported by the public purse. But it should be done. Because without innovation, pushing of boundaries, encouragment of new work, the progress of artistic life is stunted.
The support of innovative work of quality will not always receive popular approval. That is why a popularity test should never become the be-all and end-all of contributions from the public purse.

5. ATYPICAL WORKERS
Freelancers, tijdelijken, enz hebben te kampen met een beperkte sociale bescherming, zoals in resolution 31 staat:
A worker is no longer governed by labour law, but by commercial law.
He is paid by the task, in part he defines his working hours, his place of work, he becomes self-employed, with no access to social protection, unemployment insurance or company training.

En resolution 48 zegt: UNI-Mei and its affiliates are comitted
- to fight for equal labour rights for permanent staff and atypical workers with respect of social benefits, i.e. holiday pay, pension, paid parental leave, paid sick leave, unemployment benefits.
- to secure that atypical employment is NOT used to suppress the chances for being hired, for job security, for advancement of women and minorities

New workers, new rights. Directors report, pag 8, F
UNI should encourage atypical workers to adopt what is useful from traditional trade union structures, where practical, including collective bargaining, yet remain open to the new forms that may evolve to deal with new types of work.

5.b. Retirment pensions for freelance workers, Resolution 27 & Health and occupational accident insurance for freelance workers, Resolution 28.

6. GELIJKBERECHTIGING
- Grote aandacht ging naar gelijkberechtiging tussen vrouwen en mannen, gelijk loon voor gelijk werk.
- Eveneens de beeldvorming van vrouwen in de media, internet, prostitutie, porno:
Uni-mei will work for the definition of ethical guidelines to all types of media.
Calls for widespread agreement that certain types of media content - like violent pornography or child pornography - are completely unacceptable and degrading to women, and should be strictly regulated with the enforcement of relevant legislation.

Bigger than life

7. GEZONDHEID & VEILIGHEID,
Resolution 43, Hierin staat o.a.:
- to lobby our governments to address the issues of health and safety as a matter of urgency.
- to campaign for the establishment of institutions of safety and health standards as statutory bodies.
- to pressure all governments to be signatories to international instruments on health and safety e.g. ILO (International Labour Organisation) conventions.

UITSMIJTER
Vicky Riskin, WGAW (Writers Guild America West):
Toen de sheriff een lokaal radiostation belde in Minnesota om de mensen via de radio te waarschuwen bij een chemisch ongeluk, raad eens wat...
Er nam niemand op, want dit station was opgekocht en werd gerund en bediend vanuit een andere staat...

Het moge duidelijk zijn dat de globalisatie, de fusies en het cross-ownership in de media en entertainmentsector een aantal gevaren inhoudt.
Vooral in deze sectoren, wegens de intieme relatie die bestaat tussen de media en de gemeenschap waarin we leven, ons cultureel en democratisch leven.
Slechts enkele bedrijven en enkele individuen beheersen een heel groot deel van deze markt.. Wat een macht in enkele handen...

Nu zijn het de top 25 media groepen die entertainment, communicatie, geschreven pers, productie, distributie en uitzenden beheersen. Terzelfdertijd zijn ze daardoor ook 'gatekeeper' voor anderen. Zij kunnen dus de toegang voor onafhankelijke bedrijven onmogelijk maken.
WGA (Writers Guild of America) voorspelt zelfs dat binnen enkele jaren al die macht en invloed in de handen zal zijn van slechts 4 organisaties.
Sommige conglomeraten zoals Disney\Capital Cities-ABC of Time Warner\TBS hebben nu al een jaarlijke omzet die groter is dan het BNP (Bruto Nationaal Product) van sommige middelgrote landen.
(Maar Walt Disney bouwde ook een splinternieuwe Concert Hall voor het LA Philharmonic Orchestra die in oktober 2003 opengaat. Af en toe doet men ook goede dingen met veel geld).
Mickey Mouse is wel heel groot geworden...
